1. Website information
We work to keep menu items, prices, images, availability, hours, and other website information accurate. Restaurant operations can change quickly. Information may be corrected or updated without notice, and customers should call when information is time-sensitive or medically important.
2. Pickup food and one-time pickup tiffins
Restaurant orders submitted through this website are for pickup at 85B John St S, Hamilton, ON L8N 2C2. Customers may combine eligible restaurant menu items and one-time pickup tiffins in the same cart and submit them through the same review-and-acceptance workflow.
Website checkout does not provide delivery. Doorstep tiffin prices and monthly 5-day or 6-day plan prices may be displayed for comparison, but those services are arranged directly with the restaurant and are not added to this pickup cart unless the website specifically identifies the record as a one-time pickup tiffin.
The Unlimited Gujarati Thali may be ordered online only at the posted takeout price. Unlimited refills are a dine-in service and do not apply to takeout orders.
3. Submission is a request, not immediate acceptance
Submitting the checkout form sends an order request to Shivshakti. The first confirmation page and “request received” email acknowledge receipt only. They do not mean that the restaurant has accepted the order, started preparation, guaranteed every item, or received payment.
The request becomes an accepted pickup order only when the restaurant sends an acceptance or updated-order email and the secure order-status page displays the order as confirmed. The accepted order, including its final items, quantities, customizations, tax, total, and pickup time, replaces the earlier request.
4. Restaurant review, edits, and customer approval
Before acceptance, staff may remove an unavailable item, reduce a quantity, adjust the pickup time, or contact you to discuss a substitution or other change. Removed or changed lines are identified in the final acceptance communication when technically available.
The system requires staff to record customer approval before adding an item, increasing a quantity, changing a customization, or increasing the total. Approval may be documented after a phone call, in-person conversation, or another recorded method. You remain responsible for reviewing the final acceptance email and contacting the restaurant promptly if it does not reflect the agreement.
5. Restaurant-confirmed pickup timing and Sunday Special scheduling
Customers do not choose the final pickup time before submitting a website request. The restaurant first reviews item availability and current kitchen workload, then assigns the exact pickup time when accepting the order. The confirmed time is sent in the acceptance email and displayed on the secure order-status page.
Sunday’s Special items are prepared for Sunday service only. On Sunday, they may be requested for same-day pickup while available. Before Sunday, the website may allow customers to order them ahead for the upcoming Sunday shown on the menu. Adding a Sunday’s Special item to a cart before Sunday schedules the complete cart for that same Sunday service date. The restaurant reviews the request and confirms the exact Sunday pickup time before acceptance.
A Sunday Special order may not be moved to a non-Sunday date through website checkout. Accepted future-Sunday orders remain scheduled and should not enter kitchen preparation before their service date.
Please wait for the acceptance email before travelling, and wait for the ready-for-pickup email when practical. Arriving early does not require the restaurant to release food before it is safely prepared.
6. Prices, Ontario HST, and payment
Prices are stated in Canadian dollars. Current menu and pickup-tiffin availability, base prices, selected customization charges, and quantity calculations are revalidated on the server before a request is stored and again when staff edit or accept it.
The website displays the configured Ontario HST estimate and final accepted amount due at pickup. No card or bank information is collected online and no online tip is charged. Payment is completed at the restaurant, and the in-store payment receipt is the payment record. If an in-store register calculation must legally or operationally correct the website estimate, staff will explain the correction before payment.
7. Customer contact information and communications
A valid name, phone number, and email address are required for website requests so the restaurant can identify the customer, discuss availability or changes, send status communications, and address problems. You are responsible for providing accurate contact information and monitoring calls and email, including spam or junk folders.
Depending on the order lifecycle, communications may include request received, acceptance, edited-order notice, rejection or cancellation, ready for pickup, account setup, and customer-service messages. Email or network delivery cannot be guaranteed, so the secure order-status page and restaurant phone remain available.
8. Admin-created phone, counter, and guest orders
Authorized staff may enter an order into the same system after a phone call, counter conversation, or other customer request. Staff may create the order as a guest record or use available customer contact details. If a valid email address is supplied and the order is confirmed, the system may send the same final order and status communications.
9. Changes, cancellation, rejection, and uncollected orders
Call the restaurant immediately to request a change or cancellation. A request is not guaranteed after acceptance or preparation begins. The restaurant may reject or cancel an order because of unavailable items, inability to contact the customer, closure, technical problems, suspected fraud or abuse, unsafe instructions, or other reasonable operational causes.
Because website payment is not taken, a pre-payment cancellation normally does not create an online refund. Repeated fraudulent, abusive, or uncollected orders may result in future requests being limited or declined.
10. Food, customizations, images, and allergies
Food and tiffin images are representative and actual presentation, colour, ingredients, and portion appearance may vary. Tiffin contents are governed by the description shown for the selected tier. Menu option selections and the single overall order-instructions field are requests and are not accepted until the restaurant confirms the order.
Shivshakti is pure vegetarian, but not allergen-free. The overall order-instructions field is not a guarantee against cross-contact. Customers with a severe allergy, celiac disease, medically important intolerance, or other significant dietary restriction must call the restaurant before ordering. We may decline an instruction that cannot be accommodated safely.
11. Guest checkout, customer accounts, and promotional consent
You may order without signing in. Orders are linked to a private customer record by normalized email, and a secure setup link may be emailed so you can activate login access for tracking and history. Promotional-email consent is optional, separate from ordering and account access, and not selected by default.
12. Secure status links and acceptable use
Order-status links are private capability links. Do not forward them. Do not attempt to access another customer’s order, manipulate prices or status, submit fraudulent requests, overload the service, bypass controls, scrape protected information, or interfere with website or restaurant operations.
13. Records and monthly reports
The restaurant may retain order events, edits, customer-approval records, notifications, payment-at-counter status, and monthly operational reports for customer service, accounting, tax, security, dispute, and legal purposes. Access is limited to authorized administrators and service providers as described in the Privacy Policy.
14. Contact and applicable law
Nothing in these terms excludes rights or remedies that cannot legally be excluded. Questions should be directed promptly to +1 (905) 522-1555 or contact@shivshkti.com. These terms are governed by laws applicable in Ontario and Canada, subject to mandatory consumer rights.
